These Terms & Conditions ("Terms") govern your use of scarletadvertising.com (the "Site"), operated by Edgar Buelna, doing business as Scarlet Advertising ("we," "us," or "our"). By using the Site, submitting an application, or booking a consultation, you agree to these Terms. If you do not agree, please do not use the Site.

Our services

Scarlet Advertising provides advertising and marketing services for businesses, which may include offer positioning, ad scripting and editing, paid ad management, sales funnels, and email and text message follow-up. The Site provides information about these services and lets you apply for a free consultation.

Free consultations

Consultations are free and carry no obligation to buy. Submitting an application does not guarantee that we will offer you a consultation or accept you as a client. We may decline to work with anyone for any lawful reason.

Client agreements

If you become a client, the services, pricing, payment terms, deliverables, responsibilities, and any guarantee are governed by a separate written client agreement. If the client agreement conflicts with these Terms, the client agreement controls.

Our guarantee

References on the Site to our "10–20 high-ticket clients in 90 days, or you don't pay" guarantee are a summary only. The guarantee applies only to clients accepted into the program, and only under the conditions in the written client agreement. Eligibility, including required ad spend and client responsibilities, is evaluated on the consultation. Nothing on the Site creates a guarantee by itself.

Results and earnings disclaimer

Client results and testimonials shown on the Site are from individual clients and are not typical. They are shared to illustrate how our system works, not as a promise of what you will achieve. Results depend on many factors outside our control, including your offer, pricing, market, sales process, follow-through, and advertising budget. Some results shown come from clients in industries other than yours.

We do not promise or guarantee any specific level of income, revenue, leads, clients, or business growth, except as expressly stated in a signed client agreement.

Advertising costs

Advertising spend paid to platforms such as Meta is separate from our fees, is paid by the client directly to the platform, and is not refundable by us. Ad platforms set their own rules and may reject, limit, or stop ads at their discretion. We are not responsible for platform decisions, outages, or policy changes.

Text messages and emails

By providing your phone number and email address, you agree that we may contact you about your application and consultation by email and text message, including confirmations, reminders, and rescheduling messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help. Carriers are not liable for delayed or undelivered messages. Meta disclaimer

This Site is not part of the Meta/Facebook website or Meta Platforms, Inc., and is not endorsed by Meta in any way. Meta, Facebook, and Instagram are trademarks of Meta Platforms, Inc.

Intellectual property

All content on the Site, including text, videos, graphics, and logos, belongs to Scarlet Advertising or its licensors. You may not copy, reproduce, or distribute it without our written permission.

Acceptable use

You agree not to submit false information, use the Site for any unlawful purpose, attempt to interfere with the Site or its systems, or use automated tools to access or submit forms on the Site.

Third-party services

The Site uses third-party services, such as video players and calendar tools, and may link to other websites. We are not responsible for their content, availability, or practices.

Disclaimer of warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100). This section does not limit any rights you have under a signed client agreement.

Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses arising from your misuse of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in San Diego County, California.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Continued use of the Site after changes means you accept the updated Terms.
